"According to the Madrid Principles, Armenia should in the first place withdraw its troops from 5 regions, and from 13 villages in the Lachin region, following which all borders and channels of communication will open, and donor conference will be convened,” detailed Azerbaijan’s Foreign Minister Elmar Mamedyarov at a press conference in Baku yesterday, referring to the resolution of the Karabakh Conflict. In the words of the latter, “the next step should include the placement of international observers to ensure the security of the returning refugees, and the restoration of infrastructures”. “Then, Armenian troops will be withdrawn from Lachin and Qelbajar regions as well, and all the roads will open. Following the return of the Azerbaijani population to Karabakh, the necessary conditions will be created so that decisions regarding the status of Nagorno Karabakh may be considered in the last phase. Karabakh will receive the highest level of autonomy within the boundaries of Azerbaijan’s territorial integrity and sovereignty,” Mamedyarov stated. In addition, at a meeting with Mamedyarov yesterday, OSCE Chairman Joao Soares, whose delegation had left Armenia for Baku, announced that the time for the resolution of Karabakh conflict has arrived and that it is necessary to take advantage of that opportunity. And, in Baku, Goran Lenmarker, the representative of the president of OSCE’s Parliamentary Assembly in matters dealing with NK, has announced yet again that Karabagh will not join the ongoing negotiations: “The Armenian community of Karabakh cannot join the process of the negotiations surrounding the conflict. There is a format well-known to all involved, and the negotiations will continue to proceed within that same format”, he said. On Saturday, on the other hand, during a discussion where he summarized the activities of the NKR Ministry of Foreign Affairs in 2009 and presented an action plan for the year of 2010, President Bako Sahakyan announced that one of pivotal issues of the NK conflict resolution is the restoration of the high-level negotiation format with the full participation of Karabakh as a negotiating party.

"Everything was stolen before we arrived"

Recent developments confirm the information published in our newspaper last August according to which, a document had been signed during the Aliyev-Sargsyan meeting in July — or pre-signed — about the resolution of the NK conflict. A close scrutiny reveals that the issues currently being discussed at the negotiating table are not the principles of resolution but the beginning of the implementation of agreements reached earlier. Otherwise, how can one explain the announcements made by French President Nicolas Sarkozy at the meeting with Serzh Sargsyan and reported by the Associated Press?

Our readers may recall that during the meeting with Sargsyan, Sarkozy expressed his concerns about the postponement of the resolution of the Karabakh conflict and called on the parties to take “the necessary steps and make mutual concessions”. Please bear in mind that Sarkozy here does not speak about reaching agreements on problems, principles or mechanisms. Rather, he refers to the implementation of certain known steps and mutual concessions (notice that the words “steps” and “mutual concessions” are used with the definite article “the”, so that they speak not about vague but about well-defined steps and mutual concessions). Thus, taking into account the fact that Azerbaijan has already agreed to the revised Madrid principles, Sarkozy’s call to take the necessary steps and make mutual concessions, at least at this stage, surely refers only to the Armenian party.

On Saturday, at the OYK (Orinats Yerkir Party) Committee meeting, Artur Baghdasaryan decided to dismiss two of his ministers, RA Minister of Transport and Communications Gurgen Sargsyan, and RA Minister for Emergency Situations Mher Shahgeldyan.

At the same time, the “OYK decided” to appoint Armen Yeritsyan, the Deputy chief of the RA Police, to the post of RA Minister for Emergency Situations. Manuk Vardanyan, the former president of the Real Estate Cadastre, was appointed to the post of RA Minister of Transport and Communications. The OYK states that both of them have become official Party members. However, when we asked the Information Department of the RA Police whether Deputy Chief Armen Yeritsyan had handed in his resignation, the answer was: “We do not have an answer at this time.” If, in fact, Yeritsyan did not resign and the OYK is not lying about his affiliation to the Party, then the RA Law on Police, by which police department employees are not allowed to be affiliated with any party, has been violated.

In Armenia, the exchange rate for 1 US Dollar is nearing the 400 AMD mark. Yesterday, in the Armenian Stock Exchange, the average selling rate was 396.97 AMD for 1 USD, while the buying rate was 397 AMD, against Friday’s 395 AMD.

At the same time, prices are slowly creeping up in the small- and medium-sized markets: prices for basic necessities are increasing by 5 or 10 drams a day. In supermarkets, sales events with discounted prices are decreasing daily.

Decision to be declared on March 9

On March 9, at 11:00am, the Criminal Court of Appeals will declare the verdict on the case of Nikol Pashinyan, editor-in-chief of Haykakan Zhamanak. As it is known, the attorneys requested that the court acquit the political prisoner.

Yesterday, while the deliberation of the appeal by Nikol Pashinyan’s attorneys Lusine Sahakyan and Yervand Varosyan continued in the RA Court of Appeals, the RA Constitutional Court was supposed to discuss another case of Nikol Pashinyan, in which Pashinyan appeals, as a parliamentary candidate of the 10th electoral district, to consider the results of the January 10th extraordinary Parliamentary elections of the 10th electoral district of Yerevan null and void.

But the CC determined that it doesn’t have the necessary conditions to ensure Nikol Pashinyan’s right for a just trial. As it is known, the political prisoner stated in his appeal that he would like to be present at the deliberation process. Yet the CC announced the hearings open without Nikol Pashinyan.

At a joint Press Conference with EU President Spanish Foreign Minister Miguel Moratinos in Yerevan yesterday, RA Minister of Foreign Affairs E. Nalbandyan announced that the Republic of Armenia has presented proposals regarding the revised Madrid principles (on NK conflict resolution).

Azerbaijani Foreign Minister E. Mamedyarov, on the other hand, announced that Azerbaijan saw no need to make any proposals; he has said that Azerbaijan agrees with the proposals.

At 11:00am today, the Court of Appeals is scheduled to begin deliberations of the appeal by Nikol Pashinyan’s attorneys, whereby the attorneys had requested that the court acquit the political prisoner.

We would like to remind our readers that Mnatsakan Martirosyan, the judge at the court of the first instance in Yerevan’s Kentron and Nork Marash communities, had sentenced Nikol Pashinyan to 7 years of imprisonment. Matso had declared the sentence charging Nikol Pashinyan under article 225.1 of the RA Criminal Code (organization of mass disorders). For the second charge against Nikol Pashinyan, under article 316.1 of the RA Criminal Code (violence against a public figure), Matso acquitted Nikol Pashinyan by his sentence.

Levon Ter-Petrossian
First President of RA Levon Ter-Petrosyan has addressed letters to EU President Miguel Angel Moratinos and to EU High Representative of Foreign Affairs and Security Policy, Catherine Ashton.

Yesterday, Levon Zurabyan, coordinator of the Armenian National Congress passed the letters on to the EU delegation. Following the meeting between the representatives of the Armenian National Congress and the EU delegation headed by President Spanish Foreign Minister Miguel Angel Moratinos, Mr. Moratinos expressed the wish to also speak with L. Ter-Petrosian. We were unable to get any details about the telephone conversation. According to the ANC report, at the meeting with the EU President, Levon Zurabyan discussed issues relating to democracy, the defense of human rights, political prisoners in Armenia, and presented the national struggle being waged in the country for the reestablishment of Constitutional order, underscoring the necessity of holding extraordinary Presidential and Parliamentary elections. Also presented were ANC’s perspectives on the NK Conflict and Armenian-Turkish relations.

The Criminal Court of Appeals of the Republic of Armenia has scheduled the deliberations of the appeal by Lusine Sahakyan and Yervand Varosyan, attorneys to Nikol Pashinyan, Editor-in-Chief of Haykakan Zhamanak, for 11:00am, on March 3.

As it is known, the attorneys requested that the court acquit the political prisoner. Within the triumvirate at the Court of Appeals will be Presiding Judge Serzhik Avetisyan, as well as Judges Margo Simonyan and Arshak Khachatryan.
According to our sources, the Court of Appeals has been instructed to hear the case and conclude it as soon possible—by March 5, when the Constitutional Court is scheduled to hear Nikol Pashinyan’s appeal to declare the results of the January 10th elections of the 10th electoral district of Yerevan, null and void.

Against the Resolution

“It would not be desirable to adopt any resolution at the US Congress with respect to the Armenian Genocide. Now, as we try to normalize Armenian-Turkish relations, such a resolution can not be of benefit to the process,” said Hilary Clinton yesterday, at the hearings of Committee on Foreign Affairs of the US House of Representatives, referring to the Armenian Genocide Resolution (H.Res.252).

She also stated that “while the Nagorno Karabakh conflict is not a precondition for the normalization of Turkish-Armenian relations, its resolution would nevertheless bring peace to the region.”
We are in constant communication with the leaders of Armenia, Azerbaijan and Turkey and as much as our resources allow, we intend to do everything we can to push forward the process of ratifying the protocols as well as finding a diplomatic solution to the Nagorno Karabagh conflict,” said Clinton, in essence alluding that the ratification of the protocols hinges on the progress made in the resolution of the Nagorno Karabagh conflict.
